Conditions of Sale
  1. By submitting a written or telephone purchase order, an online bid or by participating in person as a room bidder, each bidder at the OstLicht Camera Auction expressly accepts the terms and conditions of the auction.
  2. The auction is open to the public and shall be conducted in accordance with the provisions of the Trade Regulation Act and in compliance with the statutory conditions. Place of performance is the registered office of the Auction House and place of jurisdiction is Vienna.
  3. The appraisal and technical determination of the objects were carried out by experts of OstLicht Camera Auction. Errors and misprints excepted. Corrections to the description in the online catalogue can be made until the auction. 

  4. If a bidder is unable to attend the preview, we will be happy to provide additional information by e-mail. Detailed photographs of all objects can be viewed in our online catalogue www.ostlicht-auction.com.
  5. Pre-bids can be submitted in writing or by e-mail or via our online catalogue or via other online platforms. The bids must include the address of the client, as well as the highest bid in EURO. The prices quoted are maximum prices, the premium will be charged additionally in the event of a successful bid. In any case, the lot will be knocked down at the lowest possible amount for the bidder.
  6. For lots from 500 EURO you can register for telephone bidding. Telephone bidders will be called by OstLicht Auction before the requested lots are called. However, no guarantee can be given that the telephone connection will be established.

  7. Room bidders will receive a bidder number upon presentation of identification or a valid credit card prior to the start of the auction.

  8. The Auction House reserves the right to request proof of liquidity from a remote bidder, to require an advance payment for high bids or the deposit of a valid credit card.
  9. For lots exported to third countries outside of the European Community or purchased with a valid UID number, the Premium is only 20%. For lots exported to third countries or auctioned with a valid UID number, the Premium is only 20%. For EC buyers the purchase price for lots consists of the hammer price plus the premium of 24% (incl. VAT). Exceptions are those lots marked with * next to the starting price. Here the premium is 20% plus 20% VAT, provided the lots remain in the EC.
    If bidding via one of the live bidding platforms (e.g. LiveAuctioneers), an additional fee of 3% to 5% will be charged depending on the platform
  10. However, you have the option of bidding live or placing pre-bids via our own platform (www.ostlicht-auction.com) at no additional cost.

  11. The auction takes place in the order of the catalogue numbering. The catalogue text of the printed edition of the auction catalogue shall be authoritative. The Auctioneer is entitled to reject bids and to cancel a knockdown already awarded in order to further increase the value of the item in question.

  12. The starting price is the starting price stated in the catalogue, unless there are several higher written bids.
    The bidding will be increased by approx. 10% of the starting price. If there are several identical written highest bids, the decision will be made in favour of the first bid received. In principle, lower bids will not be accepted. The prices are in EURO, also the invoices have to be paid in EURO.
  13. Ownership of the auctioned goods shall not pass to the buyer until payment has been made in full. In the event of a successful bid, the buyer undertakes to accept and pay for the lot purchased by him at the auction. The auctioneer shall not be entitled to take back auctioned items.

  14. The objects are insured until the buyer takes possession of them, but for a maximum of 14 days after the auction. From then on, the buyer is liable for the lots purchased by him.

  15. The auctioned lot will be handed over to the highest bidder only after full payment of the hammer price and the buyer's premium, as well as any applicable taxes and fees.

  16. Hall bidders must pay for and collect the auctioned item at the end of the auction. If payment is made by credit card, 3% will be added to the purchase price. For lots purchased in writing, by telephone or online, you will receive an invoice including bank details. This is to be paid within 8 days after receipt without deduction and including bank charges. In the event of late payment, interest on arrears will be charged at a rate of 5% p.a. above the base rate of the Austrian National Bank.
  17. Costs for packaging, transport and transport insurance are shown separately in the invoice. These are charged at cost price and we make every effort to be able to offer the most favourable transport and insurance rates. A storage fee of 5 to 20 EURO per day and item may be charged for auctioned items that have not been collected after 30 working days from the date of invoice. In case of refusal of acceptance, delay in payment or non-payment, the buyer shall be liable for all resulting damages and consequential costs.
  18. Lots not paid for or only partially paid for may be auctioned again. In this case, the original buyer shall be liable for the reduced price and shall not be entitled to any additional proceeds.
  19. Auctioned items will not be taken back. However, if it is an obvious and serious misdescription and the buyer has not personally inspected the item, this circumstance can be claimed in writing no later than 8 days after receipt. If the complaint is accepted as valid, the buyer shall be entitled to a refund of the purchase price and the buyer's premium if the auctioned item is returned at the same time.
  20. We cannot guarantee the technical function of the auctioned items.

Payment & Delivery

The invoices for the purchased lots will be issued to the highest bidder a few days after the auction has ended. When issuing your invoice, we already take into consideration the shipping costs based on your shipping requirements, the shipping address, and the package size. Buyers who have provided their e-mail address will receive their invoices first. All buyers who have only provided a postal address will receive their invoices by mail.

 

Net payment to the auctioneer for the purchased photographs is due in full within eight days following receipt of the invoice. Payments can be made via bank transfer, credit card, or PayPal—the buyer shall be responsible for all expenses incurred in these payment methods.

 

The purchased items will ship after payment has been made. While we endeavor to keep the time between payment receipt and shipping brief, there might be some delay depending on the number of photographs to be shipped. Packaging, shipping, and transport insurance costs are not included and will be charged extra. Please note, however, that because of our various agreements with delivery companies we only charge prime costs and can offer the procurement of low-priced transport services and insurance. All storage and packaging, however, is generally at the buyer’s risk.
